Terms of Service

1 Acceptance of Terms

By downloading, installing, accessing, or using the VerifySMS application ("App") or any related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

You represent and warrant that you are at least seventeen (17) years of age or the age of majority in your jurisdiction, whichever is greater. If you are under the required age, you are not permitted to use the Service.

2 Service Description

VerifySMS provides temporary virtual phone numbers for the purpose of receiving SMS verification codes. The Service is designed to help users verify accounts on third-party platforms without disclosing their personal phone numbers.

• The Service is available exclusively through the iOS application distributed via the Apple App Store.
• Virtual phone numbers provided through the Service are temporary and may be recycled or reassigned after their designated expiration period.
• VerifySMS acts solely as an intermediary service facilitating the receipt of SMS messages. We are not a telecommunications provider, carrier, or mobile virtual network operator (MVNO).
• The availability of phone numbers from specific countries or regions is subject to change without prior notice and depends on third-party provider inventory.

3 Account

To access the Service, you are required to create an account using Apple Sign In. By creating an account, you agree to the following:

• Each individual is permitted to maintain one (1) account only. Creating multiple accounts may result in the suspension or termination of all associated accounts.
• You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account.
• You agree to notify us immediately of any unauthorised access to or use of your account.
• We reserve the right to suspend, restrict, or terminate your account at our sole discretion if we reasonably believe that you have violated these Terms or engaged in any activity that is harmful to the Service, other users, or third parties.

4 Payments & Credits

The Service operates on a credit-based system. Credits are the in-app currency used to rent virtual phone numbers and receive SMS verification codes.

• Credits are purchased exclusively through Apple In-App Purchase ("IAP"). All payment transactions are processed and managed by Apple Inc.
• By making a purchase, you agree to Apple's Terms and Conditions governing In-App Purchases.
• Credits are non-transferable. You may not sell, trade, gift, or otherwise transfer credits to another user or account.
• Purchased credits do not expire and will remain in your account for as long as your account is active and in good standing.
• Pricing for credit packages is displayed within the App and is subject to change. Any price changes will apply only to future purchases.

5 Refund Policy

We are committed to fair practices and have established the following refund policy:

• If an SMS verification code is not received within the designated service window for a rented number, an automatic refund of the credits spent will be issued to your in-app wallet.
• Refunds are credited to your in-app wallet balance, not to the original payment method. These refunded credits may be used for subsequent transactions within the Service.
• For refunds of the original Apple In-App Purchase payment, you must contact Apple Support directly, as all payment processing is handled by Apple.

6 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. The following activities are strictly prohibited:

• Using the Service to facilitate, support, or engage in fraud, scams, phishing, identity theft, or any other illegal or criminal activity.
• Using the Service for spam, unsolicited messaging, bulk SMS operations, or any form of automated mass communication.
• Attempting to circumvent, disable, or interfere with the security features, rate limits, or operational mechanisms of the Service.
• Reselling, sublicensing, or sharing virtual phone numbers or access to numbers obtained through the Service with any third party.
• Using the Service to harass, threaten, defame, stalk, or otherwise violate the legal rights of any individual or entity.
• Violating any applicable local, national, or international law or regulation in connection with your use of the Service.
• Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, underlying algorithms, or architecture of the App or Service.

Violation of this Acceptable Use Policy may result in immediate account termination, forfeiture of remaining credits, and, where appropriate, referral to law enforcement authorities.

7 Intellectual Property

The Service, including but not limited to the App, its design, code, graphics, user interface, text, and all other content and materials (collectively, "Content"), is the exclusive property of VerifySMS and is protected by applicable intellectual property laws.

• The name "VerifySMS", associated logos, and branding elements are trademarks of VerifySMS. You may not use these marks without our prior written consent.
• Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the App on a compatible iOS device that you own or control, solely for your personal, non-commercial use.
• This licence does not grant you any right, title, or interest in the Service or Content beyond the limited use rights expressly set forth herein.

8 Third-Party Services

The Service relies on third-party providers for the provision of virtual phone numbers and SMS delivery infrastructure.

• Virtual phone numbers are sourced through HeroSMS and other third-party telecommunications partners. The availability, functionality, and performance of these numbers are subject to the operational capabilities of these providers.
• We do not guarantee the availability of phone numbers from any specific country, region, or carrier at any given time.
• Third-party service interruptions, maintenance windows, or provider changes may temporarily affect the availability or functionality of the Service.
• Your use of the Service may also be subject to the terms and policies of third-party platforms where you use the received verification codes.

9 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

• We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
• We do not guarantee that all SMS verification codes sent to rented virtual numbers will be successfully received or delivered.
• SMS delivery is dependent upon third-party telecommunications providers and networks, over which we have no direct control.
• We make no representations regarding the accuracy, reliability, or completeness of any content delivered through the Service.

10 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• VerifySMS shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.
• Our total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.
• Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the minimum extent permitted by applicable law.

11 Indemnification

You agree to indemnify, defend, and hold harmless VerifySMS, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees and court costs) arising out of or in connection with:

• Your use or misuse of the Service.
• Your violation of these Terms or any applicable law or regulation.
• Your infringement of any intellectual property or other rights of any third party.
• Any content or data you transmit or receive through the Service.

This indemnification obligation shall survive the termination of your account and these Terms.

12 Service Modifications

We reserve the right, at our sole discretion, to modify, update, suspend, or discontinue any part of the Service at any time, with or without notice. This includes, but is not limited to:

• Adding, modifying, or removing features, functionalities, or content within the App.
• Changing the pricing of credit packages, provided that any price changes will be communicated to users with reasonable notice before taking effect.
• Introducing new features or services that may be subject to additional or different terms and conditions.
• Temporarily suspending the Service for maintenance, upgrades, or security purposes.

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13 Termination

Either party may terminate this agreement at any time:

• By you: You may discontinue your use of the Service and request account deletion at any time by contacting us or using the account settings within the App.
• By us: We may suspend or terminate your account immediately, without prior notice or liability, if we reasonably believe that you have breached these Terms.

The following provisions shall survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.

14 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

• Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
• If you are a consumer resident in the European Union, you shall retain any mandatory protections afforded to you under the consumer protection laws of your country of residence. Nothing in these Terms shall affect your statutory rights as a consumer under applicable EU law.
• If you are a consumer resident in the United Kingdom, you may also bring proceedings in the courts of your country of residence.

15 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

16 Changes to Terms

We reserve the right to update or modify these Terms at any time. When we make changes:

• Updated Terms will become effective immediately upon posting to this page, unless otherwise specified.
• Your continued use of the Service following the posting of revised Terms constitutes your acceptance of and agreement to the updated Terms.
• For material changes that significantly affect your rights or obligations, we will provide notice through the App (e.g., via an in-app notification or prompt) prior to the changes taking effect.
• We encourage you to review these Terms periodically to stay informed of any updates.
